Galveston County Declares DWI “No Refusal” for Spring Break 2016

This year Galveston County has decided to participate in a “No Refusal Weekend” for driving while intoxicated (DWI) during spring break. Under the no refusal program, if an officer has probable cause to believe that you are driving while intoxicated in Galveston County then he may apply for a search warrant for your blood. Prosecutors, judges, and nurses will be working through the night to sign search warrants and take your blood. Just because the state got a warrant for your blood doesn’t mean it is automatically admissible in court; that’s just the beginning of the fight. The officer’s reasonable suspicion to stop you can be challenged, The officer’s probable cause to arrest you can be challenged.  Search warrants can be challenged. The admissibility of your blood can be challenged. There is a long fight ahead.
