Exceptional Hardship Victory in Texas Immigration Court: Client Granted Cancellation of Removal

He was originally picked up as part of an immigration raid.

His children suffered from various medical issues.

We argued — and the court agreed — that these conditions, individually, might constitute hardship, but taken together, they create a situation that is truly exceptional. The court further held that his removal would impose exceptional and extremely unusual hardship upon his spouse and children. The judge found that he met the necessary legal criteria, including continuous physical presence and good moral character. Therefore, our Form 42B – Application for Cancellation of Removal was granted and he will become a United States Legal Permanent Resident. He has been in custody for months, and will be released today.
