How Bad Is a DWI in Texas?
First-time offenders can be charged with a Class B misdemeanor, which is punishable by imprisonment for 72 hours to `80 days, a fine of up to $2,000, and the loss of your license for up to a year. However, these penalties can be increased if you:
- Had an open container of alcohol. Then, the minimum jail time can be extended to six days.
- Had a BAC of .15% or higher. In this case, the charges will be increased to a Class A misdemeanor, which increases the potential fine to a maximum of $4,000.
- Have two prior convictions. If this is a third or subsequent offense, you can be charged with a third-degree felony, which is punishable by a fine of up to $10,000 and imprisonment for two to ten years.
- Have a child under the age of 15 in the car with you. If you are arrested for driving while intoxicated with a child in the car, you can be charged with a state jail felony, which is punishable by a fine of up to $10,000 and imprisonment for six months to two years.
